Terms & Conditions:

1. Introduction

These Terms and Conditions govern the rental and use of vehicles supplied by TrackToyz (“Company”, “we”, “us”, “our”) for use on race tracks and motorsport venues.

By booking or using our vehicles, you agree to be legally bound by these Terms and Conditions.

2. Eligibility Requirements

To rent and operate our vehicles, you must:

  • Be at least 18 years old

  • Hold a valid full driving license

  • Present valid identification upon request

  • Meet any track-specific licensing or briefing requirements

  • Not be under the influence of alcohol or drugs

We reserve the right to refuse rental at our sole discretion.

3. Nature of Use

All vehicles are supplied strictly for:

  • Closed circuit race track use

  • Organised track days

  • Motorsport events approved by us

Our vehicles are NOT insured or permitted for public road use unless explicitly agreed in writing.

4. Bookings & Payment

  • A booking is confirmed only upon receipt of full payment or required deposit.

  • Prices are listed in £.

  • We reserve the right to amend pricing at any time before booking confirmation.

  • Accepted payment methods: [List methods].

5. Insurance & Liability

5.1 Insurance

Motorsport is inherently high-risk.

Depending on your package:

  • Vehicles may be provided with limited track insurance, OR

  • You may be required to purchase separate track day insurance.

Insurance (if provided) is subject to:

  • Excess of £1500

  • Policy exclusions

  • Driver compliance with track rules

You are responsible for verifying your coverage before driving.

5.2 Damage Liability

You accept full financial responsibility for:

  • Crash damage

  • Mechanical over-revving

  • Misuse of vehicle

  • Off-track excursions

  • Barrier impacts

  • Recovery fees charged by the circuit

We may use ECU data, onboard telemetry, and video to determine liability.

6. Mechanical Abuse & Over-Revving

Any evidence of:

  • Missed downshifts

  • Over-revving beyond redline

  • Ignoring warning lights

  • Launch control misuse (if prohibited)

may result in full engine or drivetrain rebuild costs being charged to the renter.

7. Track Rules Compliance

You agree to:

  • Attend all mandatory safety briefings

  • Follow all circuit rules

  • Obey marshals and officials

  • Use required safety equipment (helmet, racewear, etc.)

Failure to comply may result in immediate termination of rental without refund.

8. Cancellations & Refund Policy

Customer Cancellation:

  • More than 14 days before event: Full refund.

  • Within 5 days: Partial refund.

  • No-shows: No refund.

Company Cancellation:

We may cancel due to:

  • Unsafe weather

  • Vehicle mechanical issues

  • Track cancellation

  • Safety concerns

In such cases, we will offer:

  • Rescheduling OR

  • Credit OR

  • Refund (at our discretion)

We are not liable for third-party costs (travel, hotels, track fees).

9. Damage Assessment

Damage will be assessed:

  • Before and after rental

  • Using photos, video, and inspection reports

You will be notified of damage costs within [X] days.

All repair decisions are final.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Motorsport is dangerous and undertaken at your own risk.

  • We are not liable for injury, death, loss of earnings, or consequential damages.

  • You voluntarily assume all risks associated with track driving.

Nothing in these Terms excludes liability for death or personal injury caused by our proven negligence where prohibited by law.

11. Indemnity

You agree to indemnify and hold harmless [Your Company Name], its directors, employees, and affiliates from any claims arising from:

  • Your driving

  • Third-party damage

  • Breach of these Terms

  • Track rule violations

12. Force Majeure

We are not liable for failure to perform due to:

  • Extreme weather

  • Circuit closure

  • Mechanical failure beyond reasonable control

  • Government restrictions

  • Acts of God

13. Governing Law

These Terms shall be governed by the laws of [Your Country].

Any disputes shall be subject to the exclusive jurisdiction of the courts of [Location].

14. Media & Data

We may use:

  • Onboard video

  • Photography

  • Promotional media featuring your participation

Unless you notify us in writing prior to the event.

Telemetry and ECU data may be used for safety and liability investigations.
